By accessing or using this website, you agree to comply with and be bound by these Terms and Conditions of use, which, together with our Privacy Policy and Cookie Policy, govern your relationship with Mazzard Photography. If you do not agree with any part of these terms, you should discontinue using our website.
“Mazzard Photography”, “we”, or “us” refers to the website owner. “You” refers to the user, viewer, or purchaser of our services.

2.3 We do not guarantee the accuracy or suitability of any content; use is at your own risk.
2.4 It is your responsibility to ensure that any services or products meet your personal requirements.
3. Intellectual Property
3.1 All content, including design, layout, images, and graphics, is owned by or licensed to us.
3.2 Reproduction is strictly prohibited unless in line with our copyright notice or with prior written consent.
4. Trademarks
All trademarks not owned by or licensed to us are acknowledged on the website.
5. Unauthorised Use
Unauthorised use of this website may give rise to a claim for damages and/or constitute a criminal offence under Maltese law.
6. Specific Terms for Students, Guardians, and Parents
6.1 Courses are short-term and cannot be cancelled or refunded once started.
6.2 If in-person delivery is prevented (e.g., public health restrictions), sessions will be delivered online without refund.
6.3 Public holidays are not included unless specifically agreed in writing.
6.4 For entities or individuals making partial payments, these are non-refundable. Cancellation must be submitted in writing at least 3 weeks prior to course start. Failure to do so will result in the full amount being enforceable by legal means.
7. In-Home Tuition and Private Event Conduct
7.1 If the student is under 18, a parent or guardian must be present at all times.
7.2 Either the tutor or student/guardian may terminate the session if they feel unsafe or uncomfortable.
7.3 Smoking, drug use, or disrespectful behaviour is strictly prohibited.
7.4 Payments must only be made to Mazzard Photography. Tutors are not authorised to request or accept payment. Any such attempt must be reported immediately.
8. Course Booking and Payments
8.1 Booking Requirements
8.1.1 Applications must be submitted at least 48 hours before a course/session begins.
8.1.2 Online payment must be made at least 24 hours before the session. Without timely payment, the booking is considered void and unconfirmed.
8.1.3 Proof of payment must be sent via email for the booking to be finalised.
8.1.4 One-to-one sessions missed due to non-payment will not be rescheduled.
8.2 Right of Withdrawal (14-Day Cooling-Off Period)
If you are a consumer (private individual acting outside of business use), you have the legal right to withdraw from a booking within 14 days of receiving your booking confirmation, in line with Subsidiary Legislation 378.17 under Maltese law.

[email protected] stating your decision to cancel. If you cancel within the withdrawal period, a full refund will be processed within 14 days.
However, if you request that the course begins during the 14-day withdrawal period, you:
8.2.1 Waive your right to withdraw once the course has been fully delivered.
8.2.2 Will owe a pro-rata payment if the course has partially started.
This provision is in accordance with Regulation 13(4) of the Consumer Rights Regulations (SL 378.17).
9. Online Lessons
9.1 Lessons may not be recorded unless both tutor and student have agreed in writing.
9.2 Unauthorised recording, distribution, or misuse of lesson content may lead to legal action, including under data protection and copyright law.
10. Services and Refunds
10.1 Services booked with a partial payment are non-refundable.
10.2 Cancellation must be communicated in writing at least 3 weeks before the scheduled service start date.
10.3 Failure to cancel on time will result in the remaining balance being enforced and may lead to legal proceedings.
11. Data Protection
11.1 Mazzard Photography complies fully with the General Data Protection Regulation (GDPR).
11.2 Personal data is processed lawfully, fairly, and transparently. Full details are available in our Privacy Policy.
12. Child Protection and Legal Safeguarding
12.1 We fully comply with the Protection of Minors Act (POMA) and all safeguarding obligations under Maltese law.
12.2 POMA requirements specifically apply to tutors who are engaged in-person with minors (under 18 years of age). All such tutors must hold a valid clean police conduct certificate before commencing any physical, face-to-face engagement with students.
12.3 Any safeguarding concerns or breaches will be immediately reported to the appropriate legal and regulatory authorities in accordance with Maltese law.
12.4 Safeguarding is considered a shared responsibility between Mazzard Photography, parents/guardians, and educators, and we expect full cooperation from all parties to uphold a secure and professional educational environment.
13. Governing Law
These terms are governed by the laws of Malta. Any disputes shall be resolved under the exclusive jurisdiction of Maltese courts.
